Description

Overview

This HTS category, "Other" under unmanufactured, unstemmed, unstripped tobacco not containing wrapper tobacco, or not containing over 35 percent wrapper tobacco, and not flue-cured, burley, or Maryland leaf, encompasses a range of tobacco types that do not fit into the more specifically defined subcategories. It is intended to capture any remaining unmanufactured tobacco leaves that have undergone minimal processing, such as threshing or similar treatment, but have not been stemmed or stripped of their central rib. The focus is on the raw tobacco leaf form, ready for further processing in manufacturing.

This classification is distinguished from its sibling category, 2401.10.63, which specifically covers tobacco entered under additional U.S. note 5 to this chapter. Therefore, 2401.10.65 applies to all other unmanufactured tobacco leaves that meet the general criteria of being unstemmed, unstripped, and primarily without wrapper tobacco content, but are not subject to the special provisions of note 5.

Within this "Other" category, further subdivisions exist to provide more granular classification. These include "Flue-cured" (2401.10.65.30), "Burley" (2401.10.65.60), and "Maryland" (2401.10.65.80) tobacco types, which are distinct air-cured varieties with specific growing and curing methods that influence their characteristics. The "Other" subcategory (2401.10.65.90) serves as a final catch-all for any remaining unmanufactured tobacco types that do not align with these more specific, recognized categories.
